TERMS AND CONDITIONS: These terms and conditions (“T&C”) govern the membership of the MELCO Beyond Program (“MELCO BEYOND”).

MELCO BEYOND: Melco Beyond is a hospitality loyalty program of Melco Resorts (Macau) Limited and its affiliates (collectively, “Melco”). These T&C and Melco Beyond may be varied, suspended, or cancelled by Melco from time to time at its sole discretion.

ELIGIBILITY: 

1. All officially registered members of Melco Style membership will automatically become membership of Melco Beyond (the “Membership”).

2. All duly registered Melco Club members are automatically eligible for membership of Melco Beyond (the “Membership”).

3. Membership to Melco Beyond is also open to individuals aged 18 years or above who are approved by Melco.

4. Only one membership per person is allowed and membership is free.

5. Membership is not open to corporate entities, associations or other legal entities. 

6. Current employees of Melco, its parent company, affiliates and subsidiaries (“Employees”) are eligible to participate in Melco Beyond as set forth in these T&C. 

MELCO BEYOND MEMBERSHIP: 

1. Membership for eligible individuals who are not automatically enrolled is applied for through Melco Beyond kiosks, counters, online or by WeChat Mini program application. 

2. If Membership application is accepted, the individuals become a member of Melco Beyond (“Member”) and a physical or digital card may be issued to the Member (the “Card”). 

3. Melco reserves the right to, at its sole discretion, renounce or reject any membership application for any reason. 

4. Members may at any time end their Membership in Melco Beyond by informing Melco Resorts (Macau) Limited. 

ACCEPTANCE OF THESE T&C: By signing up to Melco Beyond Membership, accepting the Card or using any Melco Beyond benefits or complimentary services, you are requesting to become a Member of Melco Beyond and agreeing to accept and abide by these T&C. As a Member of Melco Beyond you are deemed to have accepted these T&C and you agree to abide by all rules and conditions as published and amended by Melco from time to time and shall accept as final and binding the decisions of Melco.

BENEFITS & COMPLIMENTARY SERVICES:

1. Members will be entitled to certain benefits and can redeem such benefits, within certain Melco properties and at authorized participating retailers, as determined from time to time by Melco, in its sole discretion. 

2. Complimentary services, if any, are extended at the discretion of Melco. 

3. Benefits are not redeemable for cash. 

4. Benefits will only be redeemed via a valid Card or if Membership is in good standing. 

5. The Membership and its associated benefits cannot be used in conjunction with other promotion, unless otherwise indicated. 

PROMOTIONS AND CAMPAIGNS: From time to time Melco and the retailers at Melco properties may run promotional/campaign offers for Members, at Melco’s discretion. These campaign details will have their own terms and conditions and time frame of use.

CHALLENGES: Any challenge by Members regarding the Benefits must be made within 24 hours from the date the Benefits are used and Melco’s determination on the matter shall be final and binding. 

NON-ASSIGNMENT: The Membership, the Card and any benefits granted by the Membership are non-assignable and non-transferrable and may only be used by the Member. 

CANCELLATION: If benefits are not used or redeemed within [12 months] of award, any such benefits will be forfeited and cancelled. Shorter period for cancellation may be determined in the relevant benefits’ T&C, at Melco’s sole discretion. 

PERSONAL INFORMATION:

1. You should provide true and updated personal information for the purposes of the Membership. Any change of your personal details (identification or passport details, postal / email address, contact telephone numbers, etc.) should be communicated to the Melco. Melco is not responsible for any loss due to the outdated or incorrect information.

2. By becoming a Member of Melco Beyond, you consent and authorize Melco to automatically or mechanically, process, collect, use, store, disclose and/or transfer any personal data (including data considered sensitive) provided by me or collected in connection with the activity and the related services, to any subsidiaries of the Data Controller or any other entity directly or indirectly under the control of, or owned by the Data Controller’s direct and indirect shareholders (collectively, the “Group Companies”), or to any successors or assigns, partners, service providers, consultants, and/or public entities or authorities, in the Macau SAR or in any other jurisdiction (the “Recipient Entity”), for all purposes, including to: (i) to manage your membership (ii) provide personalized services and ensuring the quality of such services; (iii) the provision of offers and rewards; (iv) compliance and monitoring compliance with applicable laws and regulations and the Data Controller’s and/or other Group Companies’ legal obligations and internal procedures, rules and policies; (v) exercise of rights and legitimate interests (including via litigation) of the Data Controller or other Group Companies; (vi) security; (vii) statistics and audits; and (viii) advertising and marketing on website, social media, or any other platforms (collectively, the “Purposes”).

3. You have the right to access, amend, and update your personal data and may do so by contacting the Melco Macau DPO at dpo.macau@melco-resorts.com.

4. Melco takes reasonable care, insofar as reasonably possible, to keep your personal information secure, but in the absence of gross negligence or willful misconduct by Melco, Melco itself will not be liable in relation thereto, including for any loss you may suffer if a third party procures unauthorized access to any of Your Personal Data you provide as a result of your Membership. Melco shall not be held liable in any way whatsoever in respect of any act or omission by or on behalf of third-party service providers (or their affiliates, officers, employees, representatives or service providers).

MISCELLANEOUS: 

1. Melco reserves the right, with or without notice, to terminate an individual’s membership, namely (but not exclusively) if a Member breaches these T&C; attempts to obtain points or benefits by providing false information or in any other improper or abusive way; behaves improperly while on any Melco properties; or otherwise is deemed unfit to be a Member by Melco. Upon termination of membership, any benefits or promotions shall be considered expired and shall be forfeited.

2. Melco reserves the right to cancel Melco Beyond at any time, in which case Melco shall provide the Member a reasonable period of time to redeem existing benefits. 

3. Melco reserves the right, at Melco’s sole discretion, to change, modify, add, amend or remove any part of these T&C from time to time and it is your responsibility to check these T&C from time to time for changes.

4. To the fullest extent permissible under applicable law, Melco and its service providers disclaim any and all liability and/or warranties whatsoever of any kind, whether express or implied, in relation to your Melco Beyond Membership. Melco and its service providers are not liable, whether in contract (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise, out of or in connection with the T&C, Your Personal Data (in the care of Melco only) or the acts or omissions of any service provider for any direct, special, incidental, indirect or consequential loss, damages or compensation of any kind, including loss of profit or loss of opportunity that result.

5. You agree to fully indemnify, defend and hold us and our agents, officers, directors, employees and suppliers, service providers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these T&C or improper use of your Membership.

6. If any clause of these T&C shall be deemed unlawful, void or for any reason unenforceable, then that clause shall be deemed severable from the T&C and shall not affect the validity and enforceability of the remainder of these T&C which shall continue to have full force and effect.

7. If you breach these T&C and Melco takes no action we will still be entitled to use our rights and remedies in other situations where you are in breach. No waiver by us should be construed as a waiver of any proceeding or succeeding breach of any clause of these T&C.

8. The English version of these T&C shall prevail wherever there is a discrepancy between the English and Chinese versions. 

9. These T&C shall be construed in accordance with the applicable laws of Macau. The Macau Courts shall have exclusive jurisdiction in any proceedings arising out of these T&C or your Membership of Melco Beyond.
